Cannabis law in Prince Edward Island (Canada)

Cannabis law Prince Edward Island (PEI) is one of the thirteen provinces and territories of Canada. The legalization of cannabis for recreational purposes came into effect in Canada on October 17, 2018, and the province of Prince Edward Island is no exception. The following is an overview of the current cannabis laws in Prince Edward Island.

Age Limit: The legal age for purchasing, possessing and consuming cannabis in Prince Edward Island is 19 years. Anyone under the age of 19 found in possession of cannabis can face criminal charges.

Retail Sale: Prince Edward Island allows the sale of cannabis through government-operated retail stores and online through the government-run website. The province has three cannabis stores in Charlottetown, Summerside, and Montague, and one in O’Leary. The stores are open seven days a week, and the operating hours are from 9 am to 9 pm. However, licensed private retailers are not allowed to operate in the province.

Possession Limit: In Prince Edward Island, adults over the age of 19 can possess up to 30 grams of dried cannabis or equivalent in non-dried form in public. This limit also applies to the amount of cannabis that can be purchased at one time. It is illegal to possess cannabis on school grounds, in vehicles, or any public place where smoking is prohibited.

Growing Cannabis: Adults over the age of 19 are allowed to grow up to four cannabis plants per household for personal use in Prince Edward Island. The plants must be grown indoors, and they must not be visible from any public place. The plants must not be sold or given away, and landlords may restrict their tenants from growing cannabis.

Driving: It is illegal to drive under the influence of cannabis in Prince Edward Island. The province has a zero-tolerance policy for drug-impaired driving. The penalty for driving under the influence of cannabis is the same as that for driving under the influence of alcohol. Penalties include license suspension, fines, and potential jail time.

Public Consumption: Smoking cannabis is prohibited in all public places in Prince Edward Island. This includes areas such as parks, beaches, and sidewalks. Smoking is also not allowed within 20 meters of any doorway, window, or air intake of a building. Anyone caught smoking cannabis in a public place can face fines.

Medical Cannabis: Medical cannabis is legal in Prince Edward Island. Patients with a valid medical document from a healthcare practitioner can purchase cannabis through the province’s online store or designated retail stores. Medical cannabis is subject to the same possession limits as recreational cannabis.

Cannabis laws in Prince Edward Island are similar to the laws in the other Canadian provinces. The province allows the sale of cannabis through government-operated retail stores and online, and adults over the age of 19 can possess up to 30 grams of dried cannabis or equivalent in non-dried form in public. However, smoking cannabis in public is prohibited, and driving under the influence of cannabis is illegal. Anyone caught violating these laws can face legal penalties.
